Jade & Why Chat that info from orangedog could be very helpful, but I am not sure where the part is that states the appeals court opinion is 4 years.
I'm from a smaller town and cannot find an attorney who is up on all the consumer protection laws. Ohio has this "Contracts Not In Writing" 6 year SOL(section 2305.07) that seems to be the middle ground and a place to move once convinced that credit cards accounts are not Written Contracts. Does anyone know how to get hold of orangedog, or know what appeals distric in Ohio he found this case? I have read Why Chats' info over and over concerning the state of Ohio SOL, on open end accounts, but then there is this problem of contracts not in writting with a 6 yr SOL. Over at Edebtnetwork.com they state Ohio Open End Accounts has a 4 year SOL but then reference UCC 2-725 Ohio statute 1302.98 Statutes on limitations on Contracts For Sale is 4 years. How they get from Open End Account to contracts for sale I do not understsnd. Ohio, it seems, is just very vague on the terminology Open End Accounts. I believe Why Chat is right, I am just having a hard time convincing my attorney that since it is not written contract, then it also must not be a "contract not in writing", therefore it comes under section 2509.09 (D) I am confused and need to get this right in my own mind if I am going to convince my attorney it's 4 years open & shut.
This appeals court case would do just that for me.
