Well, got a "response" to my second validation demand--this time with statements attached from OC, which still prove NOTHING...the funniest part was, the cover letter from CA felt it necessary to add that the e-mail account associated with this order was blahblahblah etc (deleted for privacy reasons)...my psycho ex's e-mail former account!!! They go on to say that UPS cannot determine who signed for the DSL modem "due to the elapsed time"...but I *did* figure out that I was out of town in New York for a week when it would've arrived! Easy enough for the bastard to hide/dispose of a big package with my name on it! I had my ISP, who is a dialup I've been with for 8 years now, run a log of my dialup connections for the time period in question. Who the hell would keep using dialup if they had DSL?? Lastly, got one out of the three credit reports tonight. The sons of bitch CA pulled a hard inquiry the day they received my first validation demand fax!!! Please help, I am totally seeing red right now...
I live in 9th circuit jurisdiction and am still trying to figure out how to CONCRETELY overcome the flawed but BINDING (on any court where I have jurisdiction) reasoning of Mahon. -ET
