No, the CA is NOT a "health care provider" and as such is NOT required to abide by the HIPAA rules.(for pre 4/13/2003 data).

NOW, if the same CA has a "business contract" with one or more health care providers, they are of course obligated to follow the HIPAA guidelines for any NEW data they receive AFTER 4/13/2003.
