You see, I have a defaulted Perkins Loan in the amount of around 8 thousand that is currently in judgement status. I can include it, as well as several hundred dollars in taxes, in Chapter 13. I can't include it in BK 7, so it kinda stinks.

I am not too worried over my credit at this point. It is already shot and if I file 13 it will be extremely difficult to get credit during the repayment period. That is fine, I want a break from credit cards. Plus, from what I have heard from friends and family who have filed, you get inundated with offers when you are finalized in the BK process.

Thanks for your advice. I know they can't take more than 25 percent of take home pay in Kansas with a judgement or BK 13, but was not sure if that is the average they will take in BK 13 or a lot of times less? Thanks, Marcy
