She really needs to get her exemptions appeal filed ASAP. I live in Kansas and wages were garnished. The attorney sending out the garnish did not send me the paperwork ASAP like he was suppose to, so my employer sent all the money witheld with the garnishee answer form to the attorney creditor. I looked at the answer form and it stated my company was suppose to send the money 10 days after she mailed her answer if no objections was brought up beforehand. However, she insists she was suppose to send the money with the answer at the end of the month. A few days later, we had our court date the attorney creditor did not show up so the garnishment was set aside. But the attorney creditor will not refund the money sent even though the garnishment was set aside.
She really needs to file this appeal for exemptions. It is her only hope of them taking less than the 25 percent or BK will stop the proceedings too, I think.
