FCRA Section 623(a)(1)(A)

Hmmm.

I found some bogus information on my Equifax CR from Credit Bureau of Placer County (Yeah same folks as with Mahon vs. them).

I've disputed it and had it removed.

However, I'm really ticked that it got there in the first place. It appears that as a result of that faulty information, some flakey CA contacted me threatening to sue for $17000 looking for the person whose faulty info was placed on my report, and then this year I received a notice from Fresno County Superior Court also related to the same idiot. I'm not convinced that this problem will ever go away. It doesn't appear to be identity theft, just incompetance from Credit Bureau.

This person had the same name, same city, similar business name but clearly wasn't me, as I was forced to explain. Credit Bureau never contacted me about the debt, just stuck it on my CR. It was for a past due Roseville telephone bill dated in 1999 for an address different than mine and I've lived at the same address in Roseville CA for 17 years.

Anywho, FCRA prohibits the reporting of information "if the person knows or consciously avoids knowing that the information is inaccurate."

What does that mean? These morons have caused me extreme grief, frustration, etc. due to their ineptitude. What is their responsibility to perform reasonable comparisons prior to screwing someone up?

Does anyone have any experience with that section of the code and any possible action that can be taken?
