Thanks again Why Chat for responding. It truly is a sad state of affairs, with things as they are. I do not have money to waist but i really felt it necessary to have representation so I do not come off as some sort of smart A to some judge. Also I figured this is my ballpark, so to speak, with an attorney from my area coupled with
a judge from my area, while the other side will be coming from 60 miles away. There are some FDCPA violations but as you have stated over and over again they are not the defense to litagation. The SOL issue is where I need to be. I'v called the local bar, and they have no suggestions, and referred me to a bar association 30 miles away, which is where I found this second attorney, supposedly a consumer advocate but there I met with the same results. I fear I will meet the same results from a judge where they say something like, well you just cannot take pieces of statute and put them where you want to get the results you want. Which is what this last appointment resulted in. Tort law has nothing to do with credit card debt was the second statement I received a preaching about. I can just imagin a judge saying the same, and then saying it is obviously 15 years what is wrong with you, summary judgement granted to the plantiff, now get out of here. Oh you will like this, I spent probably an hour being bounced around from one place to another when I tried to get something from the AG office on this. Finally some guy gets on the phone and says it is not for them to to tell me what the law is on this.
Sorry I am rambling on, just venting a bit. It is sad, that we the taxpayers who employ all these people judges included and then have to fight an uphill war in their area of expertise, just to get anywhere close to a level playing field.
