OK...as per Why Chat's response...I am also what they call "judgement proof" and elected to file BK7 anyway. The CA and other bill collectors do not care and will still call, write letters, and as in my case sue you. For piece of mind and to close the book on all of those "helpful" collectors I would also recommend that you talk to another attorney. One thing to also consider is that they can still sue you and attach your bank accounts.....yes they are not entitled to get the $$ but you will have to get an attorney to make them go away. In MS this would take 30-90 days on average. To clarify my position, only family income is Fed Retirement and Social Security Disability for wife. And, I do sleep better knowing that all the calls and letters have stopped.
One note to any Trolls on this issue....each situation is different and most of us really wanted to pay our bills....but sometimes bad things happen to good people.
