I hope u can point me in the right direction here.
Today by certified mail, I received a "Summons in Civl Action" rules 4 and 9. This is over an old credit card debt, that has been bought by another company.
The original is montgomery wards. The last time the card was used was in 1996. ( and paid on) This is in the state of Ohio.
My question is does this summons have a leg to stand on? It states "failure to appear and present a defense to this complaint will result in a judgment by default being rendered against you for the relief demanded in the complaint plus court costs"
I have 28 days to respond after being served.
Then it states My answer must be filed with the court witin three days after the service of a copy of the answer on the plaintiff's attorney.
I am hoping the SOL can be my defense and that is all that is needed. If so how do i go about the whole situation, there doesn't seem to be a court date set, only a response. Thank you for your time and any help!!!
