Not so sure about the FAX - One might recall Bill Clinton's successful initiative early on in his first term to render contracts sent via FAX as legally binding. If you send a FAX these scumbags can try denying receipt all they want, it won't help them and might prove them to be liars.
Look, by sending them a FAX you have a telephone record of your long-distance call to their number - make sure you don't send to a toll-free 800 line - that is evidence of transmission particularly as you will have included the date and time of transmission on the document.
Also, remember one of the updates to the 86 privacy act which outlawed listening in on cellular telephone calls. The '94 update required that all FAX machines be programmed by the user to electronically transmit the originating telephone number along with date and time in addition to whatever info the sender might have written in. This is the computer text printing at the very top of all FAX sheets. As you doubtless comply with all federal and other laws, your machine will have been so programmed, thus providing you with evidence these bugs can't deny.
The presumption is that you have written evidence in form of the original fax and the phone bill. They have no evidence to prove no one saw it as negative facts cannot be legally proven and they'd look as idiotic as they are. After all, the obvious question is begged, 'why have a FAX machine and dedicated line if no one is going to read its messages?" Absurd. Nail these creeps. They stink, they have an abominable record for all manner of rotten illegal tricks.
Peruse the board a bit, you'll soon find many postings about AssXXXX and its founder, "The Dean of Bad Debt" as he's called in "Credit & Collections" Magazine, the 'louse organ' of the collection 'industry'. A google check will provide you many hours of fine reading on this gang. You can defeat them handily. We stand ready to assist in any way that we might. This company is truly one of the lowest of the lows, quite an accomplishment given the nature of the beast.
FAX them to their demise.
