You bet it's excessive. In addition to successfully defending yourself be sure to phone in a complaint to the Federal Trade Commission and also your state attorney general and follow up with letters. The thugs suing you pull this crummy stunt over and over and over because it pays, kinda like crime. They are criminals and they can be countersued for their greedy stupidity. Make sure you hit them where it hurt$.
