Arrow, Northland, DLA 10/96

Hello everyone. I just found this site today. What an incredible resource. Thank you so very much.

I’ve done a lot of reading from a few sites and several books in the last week-and-a-half. However, I’m not certain I’ve absorbed all that I’ve read. The purpose of this post is to solicit your responses to determine if I’ve:
A. done what I should have done
B. done so properly
C. & to solicit any comments from you.

I have always lived in Missouri. Last payment to OC was 10/96. First missed payment was 11/96. I have never paid or promised to pay any CAs. Until a week ago I had never even responded to the handful of CA inquiries I received over the years. I was judgment proof.

I recently received an inquiry from Northland…, postmarked 7/18/03, demanding I pay some $3000, but that they were willing to settle for less. The inquiry notes that the “Client” is “Arrow…” & the “Store Name” is “A.F.S. Assignee of Citibank C/”

In response to the inquiry, on 8/12/03 I uploaded the CreditInfoCenter’s VOD letter (with my info, obviously) to USPS NetPost Certified Mail system w/return receipt. I augmented the VOD letter by adding a short paragraph at the beginning stating that the SOL in Missouri is 5 years. I did the same for Arrow. I received the green cards yesterday. Both of these letters were delivered/signed for last Friday, 8/15/03. Have I made any mistakes so far?

Even though the SOL had run my thinking on the validation is that if they knew that I knew the SOL issue that they wouldn’t bother to validate it or pursue me. Why would they do all the validation work if the debtor knows the debt is uncollectable? The end goal being that if they don’t validate then I can get it off my CRs. I’ll come back the CRA issue in a minute.

Yesterday, Monday 7/18, I used the same USPS NetPost Certified Mail system w/return receipt to send the “Special Letter to Collection Agency Notification of SOL” found on the oh-so-helpful Why Chat… site to both Northland… and Arrow…. While my initial VOD letter made a couple sentence note of the SOL issue, my intent this time was to minimize the chances of any lawsuits being brought by demonstrating that I know and thoroughly understand the SOL. Again, any mistakes yet?

No responses from either Arrow or Northland, yet, of course.

Related CRA issues. All items from the OC are gone from my CR. However, Arrow (whom has never, ever contacted me in any way shape or form, BTW) has listed the file with TransUnion only as a collection opened 7/01/00 & reported 7/01/02. There is no DLA listed. Northland placed a hard inquiry on my Experian CR only on 7/15/03. My Equifax CR is presently clean.

Are these dates, balances and inquiries legitimately listed on my CR? How to tell? Can someone point me in the right direction for all the details on what’s legally appropriate and what’s not under these circumstances with regard to hard inquiries based on the re-aged Arrow account (pp issue?), re-aging (e.g. 10/96 DLA which is still reportable through 9/03, I know, but there’s nothing from the OC anywhere on any of my CRs and the CA only shows the opened date), reporting/determining balances, and how & what data about collection accounts is to be listed with CRAs?

Sorry to be so lengthy, but I want to be thorough and accurate.
