I just got a summons (August 18/03) from an AC attorney for $5,900. They attached a single piece of paper to the summons - a photocopy of my application for the credit card. They refer to this as the contract I entered into with the credit card company. The date of the damages is shown as June 7, 1999. Fact is, I used to live in England until October 1999 and then moved to Florida where I live now. Letter says I must respond in 20 days to both the court and the attorney. I've read about the statute of limitations on this board and think it is 4 yrs for Florida Credit Card. But this debt originated in England. Question is : Can I use the SOL as a defence ? I read another post here where someone in Florida still got a judgement against them after nearly 5 years on a credit card debt. They have not included any other information on the summons and have not shown how they worked out the debt amount. Please help. Thank you.
