The SOL in TX has 3 years to go :( , so the SOL can't be your defense.

There isn't much that's going to get the suit dismissed unless you can prove either improper service of the summons or something else fundamentally and legally wrong with their lawsuit.

Wages can't be garnished in TX, but bank accounts can and they can also sieze any non-exempt assets. If you don't have anything that isn't exempt, then, aside from money in a bank account, there's not a whole lot the can get from you - now. Judgments will hang around for at least 10 years, and they're renewable. So, even if you have nothing NOW, they will continue to monitor your financial position and pounce on anything that you might acquire in the future.

You CAN negotiate a settlement and a payment plan before the court date or you can wait until then and the judge will send you and the lawyer off to try to settle then. Either way, you should make your settlement offer in writing and start at a low percentage - like 20% - give yourself some negotiating room and don't accept anything unless you get a signed agreement.

If you've got other debts as high as this one, perhaps you should consider bankruptcy.
