I re-read your original post on this. Did your wife file Ch 13 bankruptcy and if so, when was it dismissed for non-payment ? Was that in 12/00 ?

If that's what happened, I BELIEVE the bankruptcy would toll the SOL period (put it on hold). If the Ch 13 was then dismissed in 12/00, then, if I'm correct, the SOL would restart at that time (WhyChat, opinion ??). If that's the case, then the SOL has until sometime in December before it runs out.

However, WhyChat is, of course, correct on the UCC requirements for repo and collecting a deficiency. If those requirements were not met and you were not notified, then the SOL for them to collect a deficiency ran out in 12/2002 (2 years).
