WhyChat thank you for your prompt response.

The summons and complaint was hand-delivered by a sheriff. It has a case number and a red stamp bearing the seal of the sheriff of my county. Is the case number the same a docket number ?

I have been to your website and am following instructions for time-barred lawsuit. However, I have one more question - please assist :

I read the Fl. SOL, and it says that for open accounts the SOL is 4 years.

(1) Is a credit card account DEFINITELY an open account ?
(2) Is the signed application form admissible as a contract for any amount arising from the use of the credit card (or any checks used in place of the credit card - exact same account, checks were issued as a convenience) ?
(3) Does a specific written contract for the amount ($5,900) have to be signed in order for this debt to be treated as a written contract (which has a 5 year SOL) ?

Answers to these will help me mightily, and am very appreciative of your assistance on this matter so far.
