Scumbag CA's - or do I repeat myself? - all try to pull the five year ploy and why not? Hey, it gives them more time to work their voodoo. Many lawyers and surely judge cracker will tell you it's five years, after all, the good judge is probably good golfing buddies with many credit card poobahs who have retired down here.

The CA will pull the 'a written application is a written contract' routine because many times they get away with it. They are lying and they know it. An application is just that, an application. There is no signature of the second party to the contract - the credit issuer - and never mind that they'll try to claim it's 'implied'. Oh bullshale. One signature? Unilateral agreement, besides there's no regular monthly payments as with a car note.
A credit card is open account, four years. Inform the court that the TILA trumps any state laws and the TILA sez four. Tough for these bloodsuckers.
