You don't get a 1099C unless the company forgave the debt and sent it to you. 1099C is supposed to be mailed by January 31 of the year following the debt forgiveness. If you get one, you file an amended return - 1040X - if you are insolvent, there is a form you can attach. I think this "creditor" is just trying to scare you. The IRS gives you a lot of warning before they do they anything- lots of letters.
