First of all, the debt must be forgiven, then it is up to the one forgiving the debt to issue to you a 1099. You then must report the forgiven debt (the amount shown on the 1099) on your tax return when you file it. Sounds like some attorney is blowing smoke where the sun does not shine. How in the hell would he, or she know what you did or did not report on your income tax return. Tell him to take a hike and do not talk to them anymore.
