Cease and Desist - Original Debitor??

Hello, Recently my account (gold card) with Amex went delinquient. Amex forwarded the account to NCO (they are ruthless!) I forwarded a cease and desist letter to NCO, along with request tto validate the debt. Following this, Amex took the account over again. I have now forwarded a Cease and Desist to Amex. The Amex representative (Lisa Williams) states that the Cease and desist does not apply to her, because she is an Account Manager, not a collection agent. Does anyoen know if this is true? I am in California. Thank you!
