Ok, the Statute of Limitations in VA is 3 years, starting from the last payment or charge.

So, was it 3 years or more since you last paid on this account ??

Do you have any records ??

If not, pull your credit reports and get the dates for the ORIGINAL CREDITORS trade line. You want to look at the come-off date and/or the charge-off date.

If you determine that the SOL HAS run out, then all you need to do is send the collection agency (CA) WhyChat's SOL Cease and Desist (C&D) letter and tell them to get lost.

If the SOL has not run out yet, but is nearly there, then send them a debt validation letter - this will likely stall them until the SOL does run out.

Can they garnish your wages ?? Not without suing you and winning a judgement FIRST !
