Head of Household refers to your tax filing status. If you provide more than 50% of the support of someone living with you -or your parent - who does not need to live with you - then you are head of household.

Are you being sued, or is this just a threat?

If he files a lawsuit, you can always go to court and make a payment arrangement before they get a judgement. Then the case is put on hold as long as you stick to the agreement.
