The BK court gave a consent order to pick up the garage after the automatic stay was lifted. Does the title co or in this case the attorney who did our closing have to make sure as part of due diligence there was no UCC filings? Can I sue the mortgage co who foreclosed as they did not do their own due diligence before foreclosing, the listing realt estate agency, and best of all the title co? need lots of leverage here keyser.
