You are so right. Getting permission to tape is like asking a convenience store bandit to remove his mask and face the security camera. Florida law no doubt was passed with some gaseous, high-minded flatulent rhetoric about 'protectin' the po' lil' people of our fine ol' state'. Bullshal. It was passed to protect criminals.
A few years ago, get a load of this, a guy in a trailer park was arrested for taping his neighbors. Wiretapping? Eavesdropping? Nope. This is beyond outrageous yet typical. The neighbor was a noisy inconsiderate type who played loud music at all hours, screamed at his wife and family all day and generally made life awful for all around him.
Like so many who seem to be Powered by Satan(r), he had a knack for getting real quiet whenever the cops were called. You know the rest. The neighbors all looked like mean old cranks to the cops, picking on this poor guy, accusing him of making noises when he was so quiet.
So, one chap rolls a tape when the neighbor is running his mouth at 158 decibels. Guess what? Mr. Noisebag gets a pass and the guy who made the tape is arrested for 'unauthorized interception of oral communication'. Right. So when will bankers be arrested for photographing robbers without first obtaining permission?
Now, according to unofficial word at the FTC, forget the two-party rule bullshale. FTC people have been known to correctly point out that as youu say, the only way to catch these cockroaches is to tape them without their knowledge so....that's the way is has to be.
FTC is federal and this does tend to trump state rules made for the seeming convenience of criminals. Nail them.
