Well, deal with the lawsuit first - don't ask for anything. What is the deadline for you to answer? When did this debt become delinquent? What state are you in? What state were you in when you got the Cap One card?

Your answer is "deny any knowledge" this forces the lawyer to prove that you really do owe the debt. It might get you off completely, but it will definitely buy you some time.

Do not admit the debt is yours, do not make any offers. Your chances of getting deletions at this point are probably nil, don't start thinking that way. To get deletions for payment you have to pay a lump sum, and it sounds to me like you don't have all that money, or you would have paid the cards to begin with, right?

Give the delinquency dates of each of your accounts, that will help determine the correct course of action.
