First of all, read back a little - like a couple of months worth of posts - you are taking on too much at once.

They will not sue you because you don't answer the phone and take their abuse. They will sue you if you make them mad, but you are not going to make them mad, you are just going to delay dealing with them until you can deal with the lawsuit. I can't take the time to walk you through all of them and the lawsuit at the same time, and you wouldn't be able to do it all at once anyway.

They will threaten you if you answer the phone. They are scaring you until you can't think straight. I know I've been there.

Now WHAT STATE ARE YOU IN?????

If you lose with Capital One they will get a judgment against you and garnish your wages, if it is allowed in your state. I can't tell you whether it is or not unless you tell me what state it is.

Some states there is nothing they can do to you. Except for regular wages, you sound like you are judgment proof.

Make them prove the debt is yours, it is your legal right just like a criminal can plead not guilty when he actually committed the crime. Our laws give you certain rights, and you can use them to protect yourself, if you wish. I am trying to help you keep a judgment off your reports. Isn't that what you want? A judgment will be entered if you settle with them now.

Settling the other debts will not improve your credit. They will tell you they will delete the negative entry on your report, but they are lying, they will leave it there and your credit will be trashed for years. When you settle, you pay less than they say is owed, and they will then continue to attempt to collect the amount you didn't pay. or they will seel the debt to another CA who will come after you again.

Totally up to you. We/I can help you deal with them, and you can pay the original debt later when you have more money if your conscience bothers you.

The credit/collections system is horribly flawed, and they will put you in credit hell for years to come, if you let them.

I can steer you away from that. Then you can pay what you feel you really owe, to the original entity that loaned you the money, if that is what you feel you should do. But if you settle, you will not improve your credt, it will not help you get a mortgage at a decent rate later on.

Make them prove the debts is yours. They sue nundreds of people all at once, if you are a lot of trouble, and don't have assets, they won't bother with you.

PS - If you look back at the 2000 - 2001 posts on this board, I was the only one here helping. Why Chat joined me and now handles this board pretty much alone, since I have started my own board, and am busy with it. I am helping here while Why Chat is on vacation.
