I am new here and would appreciate any advice. I live in kansas. Last night at 8:50pm I got the suprise phone call of my life. A very mean nasty and uneducated "lady" informed me that I owed $697.85 on a bad check from 1997 wrote to a store at the mall. The actual check amount was $157.00 but I now owe legal fees and court costs. I asked her how she got my phone number and she said from my "bad" check. This is a lie I just moved here three years ago and the number is unlisted. She then proceded to say "I should be ashamed" and asked if I made a habit of writing bad checks. I knew nothing about this check. I have never heared a thing about this. It's been six years!! The check was under my first married name as was the acount. My ex closed this account shortly after our divorce.(that same year)
She then proceded to tell me if I didn't pay right then they would come and arrest me. I tried to tell her I have never known a thing about this. For christs sake it was 6yrs ago and I have been remarried for five now. I was terrified of going to jail- I am pregnant and on a no stress regiman due to problems with the pregnancy. My husband(new) got on the phone and asked to talk to a supervisor. The man on the phone said he was the "senior litigator" so my husband said "are you a lawyer?" he said no. Then we asked "do you have a law degree" he said no. He then said "is this a law firm" They said yes. So he told them he wanted "a certified letter stating the alleged debt on the letter head of the attorney handeling this case. Signed by the attorney. And a copy of the original check that I supposedly wrote."
Did we do the right thing? Can they sue me on a check I don't think I wrote from six years ago? Can they take me to jail? Do we have to pay this??
