Based on discussion on this board, my understanding is that the start date for SOL is the first delinquency prior to chargeoff. I have recently received a summons, from NCO collection agency's lawyer, which I have answered stating that the SOL has passed. I would like to send a letter to the original creditor to validate 'date of last activity' but I'm not sure of the following: 1. Should I even send a letter to the original creditor? What are my chances of getting a response? 2. I have a copy of an older credit report that shows an earlier date. Is that enough to present in court to win my case. 3. Should I send interrogatories to the plaintiff's lawyer asking for proof of 'last activity date'?
