A collection agency may not make a "hard" inquiry on your credit file. Hard inquiries are initiated by you and are for things such as an application for credit, employment, or insurance underwriting (a scam in itself). "Soft" inquiries are made by your creditors or collection agencies for account "reviews" and sometimes by lowly direct marketers if you haven't opted out. Many times if you ask for "verification" from a bad debt buyer, they drop the case because, in reality, all they really have is a dollar ammount they bought for peanuts in hopes they could con/scare you into paying. Although bad debt buyers should not be allowed to access your file..they do. If Trans union let them put a hard inquiry (one which would be visible to others besides you)on your report, then they are indeed wrong and should change the entry or delete it. Send them another cease and communication letter...This time inform them that you have no intention of EVER paying the alleged debt. Also state that you will be reviewing your credit file and will consider any entry they make an attempt to contact you. As for Trans Union, much like the other 2 "big" slimebag CRAs they are simply hiding behind the FCRA which allows them to say "it's not our problem". Come January 1, 2004 this can all be changed if the good people we put in political office allow the ban on state initiated credit reporting laws to expire. Talk to your senators/congressmen and women.
