Hello. I got a call today from W&A re: an Exxon debt. I lost my job earlier this year and haven't paid my account since April. W&A said they will only accept 80% settlement and if we don't pay they will sue. They said they won't except monthly payment terms unless we put $500 down, but even that won't stop the law suit. My question is if I send them the FDCPA letter w/a monthly payment amount and check, can they still sue?
