I'll look up all the grounds for a motion to dismiss and post them for you. You can use any that apply to your case.

The motion to dismiss can be filed before anything else and it basically freezes everything until the judge has ruled.

Can you go to the courthouse where this will be heard and read the actual file ? That way you could make sure that nothing was filed that was not sent to you.

By law, you have to be sent a copy of every paper that is filed with the court. Generally speaking, ex parte communication with the court is not allowed. (That means that they can not communicate with the judge without your knowledge.)

You might want to go to your local libary and read the rules of civil procedure for the court level that you are being sued in. Sometimes small claims court has different rules than the higher courts.
