Credit card open or written account?

I called a collection agency that was trying to take me to court over a credit card over 3 years ago. I told them that the 3 years for the SOL was over. They said that since i signed for the credit card that it is a written contract and not an opened one. I thought that you had to sign for any credit card you got fot the credit report they did. I was wondering if they are correct. I also wondered where i can find the date that my card became at fault. Ive tried the original card holder and the company that purchased the account and neither seem to have the date all they have is the charge off date for the original creditor. Please help my court date is only a few days away.
