You haven't been served yet so you could still talk to the collection agency or original creditor. They will probably refer you to the attorney. Be careful about talking to the attorney before you are served because if there are errors in service your knowledge of the suit and negotiations would undermine any defense regarding improper service. After you are served you should negotiate with the attorney, as he is the representative of the plaintiff. You make a settlement offer and they will consider it. At the same time though you need to prepare an answer and make sure you file it within the time you are given to answer. You don't want a default judgment and the harder you make it for the attorney the more likely he will settle the case. If they do get a judgment at least you will have made him have to earn his fees.
