If you go to the archives there are some posts from myself and WhyChat that went over this on Aug 20, 2003. Down below that on the Aug 17 there was a long discussion.
The problem I still have is the total lack of understanding on the part of the attorneys, and hence the judges. I talked to a couple of attorneys and they just get a blank look on their faces, when I try and tell them that CC have a 4 yr SOL, and then why. Then you get the judge who want to just go with what he understands and tells you its 15 yrs. I Talked with people in the AGs office and they do not know and will not help They think it is 15 yrs. Here in Ohio it is one hell of a mess.
4, 6, 15 its a crap shoot. If you get a judge, who thinks he is right, and is not going to have some layman tell him he is wrong, your screwed. Unfortunately I think most judges are like that. Then try and tell them that a tort sol is applicable for CC debt, and they just won't even hear of it.
I have been procrastinating in that I wanted to find a way to get our AGs office to make some sort of ruleing on all of this.
WhyChat is right, there is no place that says the SOL for cc debt is this or that, and by way of exclusion, if it don't fit here, and it don't fit there, then it either dosen't fit anywhere, or by way of elimination (exclusion) it falls into the place under tort law.
Like OJs' Glove if it don't fit you can't convict.
After all of this and looking over those older threads I mentioned you will say Ok I think I understand how it works, but the key is how do I convince some judge of this.
