Another thing to note here. If you last payment was in May of this year, then the account with the original creditor (OC) hasn't even gotten to charge-off yet (180 days of non-payment). The threats of a lawsuit BEFORE charge-off are usually nothing more than that - threats. This trashbag lawyer doesn't own this debt pre-charge-off, he's only been assigned by the OC to scare you with his 'law firm' letterhead.

Depending on who the OC is, you may not get sued for some time, even AFTER charge-off.

OH, and the reason you don't send a full C&D is because if you're within the SOL, cutting off all avenues of contact only leaves them one choice to get in touch with you - a lawsuit.
