Credit before Bk

I have been sued by my landlord (retail Business lease). The case is still pending but I know that I am going to have to file if they win.

My credit is Ok. Her's is excellent. We are purchasing a house. We would like to buy some furniture and other items on credit.

If they win I am going to have to file for BK. Can I include the debt for furniture and etc on the claim.
Would Trustee consider this fraud. What it time limit ( 60 or 90 Days). before file.
