The qualifications for CH13 BK require the ability to pay back at least 50% of your debts over a 3-5 year period.

The qualifications for CH7 BK require only that you have insufficient assets and income to meet that CH 13 requirement.

Giving advice on BK based on "in-laws" experiences in another State is not a good idea, no matter how well intended.

A response to a validation letter from a CA is not useful for BK proceedings.I NEVER suggest a validation request while within SOL as it implies a desire to protect your credit, which in turn infers an ability to pay.

A limited cease and desist MAY be used if there are harrassing phone calls.
