I copied this from the FDCPA... § 809. Validation of debts
If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. So this backs up what LadynRed said.
WE'VE got 30 days to send off the request for validation and/or dispute but they have no time limit to reply and can not continue collecting until they send the right stuff to us. Great. Now what about the BBB's statement that an un-verified debt can not be sold???? Is this true? Is it somewhere in the FDCPA? If so... how in the hhhheck is this monitored and/or enforced? This validation thing blows my mind.
