They have to first get a summary of your assets and they have to figure out what income is not exempt. They can only then take a portion of that. If it is long gone, it is long gone. I don't believe that they cannot make you pay back money that was rightfully yours in the past and that you Spent on your household income. It is like them trying to garnish my past wages. They can only garnish your present wages that are nonexempt or income that comes in that is exempt with court order and judgement in hand only. If you had already spent your income, it is gone. It is your income to spend. Until they get a court order, and take the steps to garnish your wages, any lawful earnings you make and spent are simply that and nothing more. They cannot force you to pay something that is already spent that was yours to spend. My opinion. Drew
