I am not sure how this works and would like some clarification. An attorney has a judgement filed against us in Kansas. What would he need to do to restart the SOL of five years for the judgement? Does just collecting on the judgement through wage garnishment actually restart the SOL on the judgement? Five years will be up next month. To my knowledge, he has not specifically asked for a renewal yet. We have been fighting his garnishment requests and got two of them set aside. ONe for the attorney not showing up and the other because he would not return the money for the last one that was set aside. We are waiting on the next one and hope our BK13 filing will beat it. But, if the SOL were to expire next month, then we could swithch to a BK7 since this is for a school loan and we can't discharge it anyway. Please help...sorry to write so much!!!
