Sorry it's been a while getting back, but I said I thought I would run accorss the exact Oh Statute that prevents a time barred law suit. Her it is.
Section 2305.03
"A civil action,unless different limitation is prescribed by statute, can be commenced only within the period prescribed in sections 2305.03 to 2305.22 inclusive of the Revised Code. Where interposed by proper plea by a party to an action mentioned in such sections, laps of time shall be a bar thereto".

the 4 yr tort statute 2305.09 D falls within this group, so if someone brings a time barred law suit against you they are in violation of the above mentioned statute (2305.03). Frivolous Conduct I would think would certainly include filing a law suit in violation of this statute.

Hope this helps everyone in ohio if your involved with a CA filing a time barred law suit against you.
