American Express - Going to Court soon!

I am being sued by American Express for what should have been charged back to the merchant. I am going to court on the 19th (Answer Only) and have questions. Their lawyer has presented in his complaint; a copy of there cardholder agreement (unreadable) and duplicate pages, missing pages of an October 2001 statement. Why that statement? Who knows. Questions
1) I think the Answer should be vague so they don't move for Summary Judgement?
2) Counterclaim, Setoff or Cross Claim? They violated there own Policies and Procedures. They (I think) either Violated FDCPA, or FCBA? Or was it the Electronic Transfer. This is my big problem right now. I am confused as to which applies in this situation.

Charge number one was paid to the merchant by check and then he charged my account. #2 merchandise was never delivered or even sent. Any help? PLEASE!
