There are many things unfair in this world.

I suspect that 'they' would think it unfair if the insurance company didn't pay them the full amount for services rendered for whatever reason and they couldn't bill you, the receiver of the services, and expect to receive payment.

When you had the surgery, didn't you check to see what portion would be paid by insurance and how much you would be obligated for?

Clearly it appears that the bill has come at an inappropriate time for you, and unless you could somehow prove that the insurance company was never billed within a reasonable time (and I don't even know what that would buy you), it appears that every thing is kosher.

I'm sorry if I'm not showing a lot of sympathy here. I just underwent a medical procedure Sept 2 and I had to pay the co-pay amount when I walked in the door ($800). I would love to have had it deferred for 2 years.
