Well, I am doing a combo of that. I have stopped paying my unsecured creditors. So, currently the only thing I am doing is saving money for a lawyer. I'm not in a big hurry. I am interviewing several lawyers and gathering my paperwork. I probably will not file for several months, even longer if I can. So, if and when someone sends me legal paperwork for a lawsuit, I will file bankruptcy and they will be SOL. =-)I assume I could probably wait up to a year of longer to file, we'll see.
