I know I am certainly no expert here on all of this, but after spending months follwing this and other boards it seems to me that one of our biggest problems is lack of understanding and knowledge at the judicial level. Is their a interest in forming a consumer advocate non profit organization with chapters across the country geared to the problems addressed on this and othter boards, with a purpose of keeping our local judges infomred as to what is going on within this industry. For example the FTC law suits against any Collection Agencies. The practices of mass filings on time barred law suits. I think our judges would be appreciative to know who is responsible for some of their log jammed dockets.
The idea that our judicial system is predisposed to the creditors, and that debtors are deadbeats is rediculous, and needs to be changed. I have found on this board a spectrum of very smart individulas, who for a variety of reasons, have some financial problems, my own started with a divorce out of nowhere. I see a awful lot of good people with school tuition loan problems, lost jobs, medical problems, etc., the list goes on. It is just not right that if we are forced by collection agencies to be involved in the legal system that we need to feel that first we need to overcome a bias, before getting to the problem at hand.
Our judges need to know and understand how the some of these CAs are treating people, their scams, their lies, their summary judgements by the hundreds.
I bet that only a few of our judges know that these companies pay pennys on the dollar at auctions for these accounts. I could go on and on, as I am sure many of you could also. I am in no way suggesting some sort of right wing way out their organization, quite the contrary, my main desire is to level the playing field and to change this predisposition of Oh, here comes another deadbeat into my courtroom. If we can offer, in a very constructive manner, information and knowledge that could help speed the process and provide understanding we can help a lot people from getting hurt only because our judges are uninformed, and unaware, or perhaps improperly informed.
Just a thought, and invite comment.
