Well- she is close to the 4 year SOL, presuming it was early 2000,that she last paid. Take a look at her Experian report, and see when the "removal" date is for the OC.Was the last payment an "on time" payment? Or did she have late charges and past due fees. She may, actually be past SOL.

In any case, she should send a validation/dispute/cease and desist letter to the CA,that will buy her some time, and if they don't have the required accont information to validate, they won't bother to file suit as they will see she will fight it.

As to your question, Tx is a community property State, IF they file suit and IF they freeze your joint account and IF they garnish "your" $$, you would have to go to Court to get it back.
