Providian/Chargeoff/How long until i am sued?

Owe them 11,000.00. Lost my job and they were unresponsive for a payment plan. Was charged off over a year ago. Why havent i been sued yet? When will I? This board has made me paranoid! Also, what exactly is a judgement? Why have people here had judgements against them, and were not served papers to appear in court?? Can a judgement be made against you when you arent there to defend yourself?? Im seriously considering bankruptcy (In New Hampshire), if they get a judgement(without me knowing, can i declare bankrutcy after the judgement and not be liable to pay? So confused here.
