I have a default judgement against me for a student loan. The judgement was issued in 1990, I was never served, and was under the impression that I was in an extended loan payment via permission, r/t unemployment. I have been paying a collection agency for four years at the rate of 300-400 month, and still owe over 17,000 on an original 6,000 dollar loan. My concern is that I was never served, and during the time served I was very ill and in and out of the hospital. I did manage to get a copy of the judgement and the address listed where served is not, and never was my home address where I live. This is probably the reason I never received the summons. Is this a valid reason to have the judgement vacated? If so, can I do this myself, or should I hire an attorney. I'd also like to regain the money back from the collection agencies, and pay the money directly to Guaranteed student loan program...any advice? I'm desperate!!! Thanks in advance.
