If you are in Florida the following rules apply:

Small claims court:

case can be dismissed if there is no action- read pleadings, any kind of paper filed with the court by either side for 6 months.

Circuit court:

same rule except it is one year .

Sometimes the court clerk will do this- more often you need to stay on top of this.

Basic rule of being a lawyer: if you have the law on your side, argue the law - if not - as the song from Chicago says- -"Give em the old razzle dazzle...how can they see with sequins in their eyes? "

Stay the course- pay no attention to the man behind the curtain -

And most important - no matter how "friendly he is, that lawyer is not your friend. "
