I won a case against an out of state CA in in our state of Florida because they were not licensed. They DO have to be. The judge didn't care about the SOL or anything else. I won hands down because of them with no license. Get it in writing from the state-I had it by email. Most CAs use a third party to make sure they are licensed in all states and they do a lousy job of it.
Stand your ground and don't let them wriggle out of it. You'b be surprised how many CAs aren't licensed down here.
